IMA Files Litigation to Block Workers' Compensation Rules

Minutes ago, the Illinois Manufacturers’ Association and Illinois Retail Merchants Association filed litigation in Sangamon County seeking to block the implementation of emergency rules that would create an automatic presumption that the workplace was the cause of COVID-19 cases. If left unchecked, this emergency rule will add billions of dollars in costs on Illinois employers, including manufacturers who are operating during this global pandemic in order to provide medical supplies, protective equipment for first responders, and a safe and stable supply of food.

This lawsuit is about the rule of law and the fact that the Governor’s Administration and the Illinois Workers’ Compensation Commission cannot exceed its rulemaking authority. Substantive changes in law need to be enacted through the General Assembly rather than through administrative rules that were rushed through the process with little discussion and no economic analysis.

The IMA and IRMA, on behalf of the state’s diverse employer community, are asking the Court for a temporary restraining order to protect Illinois businesses from this aggressive overreach by government.
